Consequently, the consumer fully acknowledges that the click-to-accept acceptance of these general terms and conditions of sale does not require the signature of this document insofar as he/she intends to order the products offered online within the website.
The website www.pedronirace.com is the exclusive property of Race Lab s.r.l., hereinafter referred to as "SELLER".
The consumer declares to have full legal capacity to accept these general terms and conditions of sale.
The SELLER reserves the right to amend these general terms and conditions of sale.
Article 1 - Integrity
These general terms and conditions of sale represent the entirety of the obligations between the parties.
This contract is accepted by the consumer in a distance selling system.
In this sense, the consumer is deemed to accept without reservation all the clauses contained in these general terms and conditions of sale. No general or specific terms and conditions sent or delivered by the consumer may be incorporated herein, as they are in conflict with these general terms and conditions of sale.
Article 2 - Purpose
The purpose of the present general terms and conditions is to define the rights and obligations of the parties in the context of the online sale of products offered by the SELLER to consumers.
Products are defined as: frames, bicycles and clothing products.
The consumer declares, before placing his order, that the purchase of the products is not directly related to his professional activity.
As a consumer, the customer has specific rights, which could be put at risk if the purchase is actually intended for their professional activity.

In the event of a conflict between provisions contained in documents of different levels, the provisions of the higher level document shall prevail.
Article 4 - Validity and Duration
These conditions come into force upon confirmation of the order. They are valid for the time necessary for the supply of the products purchased, until the expiry of the guarantees legally owed by the seller.
Article 5 - Order confirmation
All contractual information shall be confirmed by e-mail no later than the time of delivery or, failing that, to the address specified by the consumer in the purchase order.
Article 6 - Proof of the transaction
Records stored in the SELLER's computer systems under conditions of reasonable security shall be considered as evidence of communication, orders and payments between the parties. The storage of purchase orders and invoices shall be made on a reliable and durable medium that can be used as evidence.
The SELLER shall not be liable in any way for any loss of data as a result of an accident for which it cannot be held responsible.
Article 7 - Product information
Article 7.1
The SELLER displays the products for sale on its website with the features necessary to enable the potential consumer to know, before ordering, all the essential information relating to a particular product required prior to purchase.
The descriptions, features and illustrations of our products are made with the utmost care. However, there may be errors as well as changes made by the SELLER and we therefore accept no liability in respect of such differences nor shall the validity of the transaction be questioned.
Article 7.2
These online offers are valid while stocks last. In the event that the item is out of stock, it will not be possible to place the order and the consumer will be notified of any errors as quickly as possible.
Article 7.3
Before using your new Pedroni Race bike for the first time, you should check that each element is working properly, optimise adjustments (drivetrain, shock absorbers) and adapt the riding position to your profile.
Article 8 - Price
All prices are in euros. Prices do not include transport costs, which are added to the final invoice of the order. The price takes into account the VAT applicable on the day of the order, any price variation will automatically be applied to the price of the products online. The full payment of the order must be paid during the order process.
Under no circumstances may any amount sent be considered as a deposit. In the event of sale abroad, all applicable rates and customs charges in the purchaser's country shall be borne by the purchaser.
The SELLER reserves the right to change prices at its own discretion. Any price changes shall be notified to the purchaser prior to any order during the year depending on exchange rates and on the basis of the increase in raw material prices.
Article 9 - Payment method
Payment by credit card, PayPal, bank transfer and in instalments. Your order will only be confirmed after payment is received by the SELLER.
Article 10 - Product availability
In the event of product unavailability, specifically due to our suppliers, the consumer shall be informed as quickly as possible and shall have the possibility of cancelling or modifying his order. If an order is cancelled, we undertake to refund the consumer or issue a purchase voucher as quickly as possible.
Article 11 - Cancellation of a pre-order
If the customer wishes to be refunded after placing a pre-order, 5% of the amount paid will be retained. This will obviously not be the case if the bike cannot be delivered by the originally announced date. This is to cover the costs incurred.
Article 12 - Delivery procedure
Products are delivered throughout Europe and worldwide to the address indicated by the consumer on the order form.
Any delivery anomaly (missing parcel, missing product as listed on the order form, damaged parcels, broken products, etc.) shall be indicated on the delivery note in the form of a "handwritten and specified reservation", accompanied by the customer's signature.
The consumer shall confirm the anomaly by sending an email to info@pedronirace.com within two (2) days. The consumer shall send a copy of the signed delivery note by e-mail to the SELLER.
The consumer is responsible for verifying the condition of the package and the number of packages delivered in the presence of the driver. In case of doubt, the consumer shall refuse the delivery and inform the SELLER.
All our shipments are covered by insurance corresponding to the value of the package sent, which remains the responsibility of our company.
Article 13 - Shipping and delivery times
Bikes and frames are generally dispatched within a maximum of three weeks after confirmation of order, while clothing is dispatched within a maximum of (2) working days.
Delivery times are generally between (4) and (6) days in Italy. For deliveries to the rest of the world, times are determined on the basis of the delivery times communicated by the delivery company. Please bear in mind that the delivery times indicated are only indicative and may vary. Any delays shall not result in any compensation, suspension of payment or cancellation of the order in favour of the purchaser.
Article 14 - Returns
The consumer has a period (14) days from the date of receipt of the goods to return the item for exchange or refund at no additional cost except shipping costs. If the product is customised, we do not accept full returns but only repairs.
Products must be returned as new, never used, in their original packaging and in perfect condition. Returns that do not meet these criteria will not be refunded and will remain available for the consumer at our offices.
To request a return, please contact us at: info@pedronirace.com specifying your order number, references and the reason for the return and your availability to be contacted and informed of the return number. The return request will be considered and the SELLER will endeavour to give a reply within one (1) week from receipt of the request.
The SELLER shall make the refund using the same means of payment chosen by the CUSTOMER at the time of purchase. In case of payment made by bank transfer, and should the CUSTOMER intend to exercise his/her right of withdrawal, he/she shall provide the seller with the bank details: IBAN, SWIFT and BIC necessary for the execution of the refund.
The SELLER reserves the right to agree to a replacement or refund only and only when the product has been returned
Article 15 - Errors of delivery
The consumer shall report to the SELLER, on the day of delivery or at the latest on the first business day after delivery, any claim relating to delivery errors and/or non-conformity of the product in kind or quality as specified in the order form. Any claim made after this deadline shall be rejected.

Article 16 - Delivery charges
Delivery charges shall be indicated and added to the total of each order placed by the Buyer. The amount of postage shall be adjusted according to the destination of the order.

Article 19 - Partial non-confirmation
Should one or more of the provisions of these general terms and conditions of sale be deemed invalid or declared invalid by any law, regulation or as a result of a final decision of a competent jurisdiction, the remaining provisions shall remain in full force and effect.
Article 20 - Waiver
Failure by a party to claim a breach of any of the provisions of these conditions shall not in the future be construed as a waiver of the obligation in question.
Article 21 - Applicable law
These general conditions shall be governed by Italian law. In case of complaints or disputes, the consumer shall first contact the SELLER in order to find an amicable solution.
